Acceptance of terms

These terms and conditions govern all supply of goods and services ("products") by Inner Storage limited ("{Inner Storage Limited}", "we, "us") to you, the purchaser of goods and services from us, including your use of the website at {www.innerstorage.nz} ("the website"). They are effective from {01/11/2021} and will replace all earlier {Inner Storage Limited} terms of trade and any conditions contained in any document used by you and purporting to have contractual effect.

We reserve the right to change these terms of trade by notice to you. Notice may be given by posting the revised terms and conditions on our website.

To make a purchase from our online shop you must be 18 years of age or over.

Purchases from our online shop may only be made by persons who are acquiring goods or services for their own use or consumption, and you must not acquire goods from us via the website for resupply (whether in trade or otherwise).

If you are purchasing on behalf of another entity such as a company you warrant you have the authorisation to agree to these terms and conditions on behalf of the entity.

Availability and supply

All orders are subject to the availability of those products or services. If for any reason a Product is not available, we will endeavour to notify the non-availability on our online shop.

Delivery and delivery charges

Prices for goods and services stated on our website are exclusive of any applicable delivery charges.

We only deliver to New Zealand street addresses. The cost of delivery is as stated on our website and a total delivery cost will be provided in the order summary we in your online shopping basket.

We will use all reasonable endeavours to ensure that orders for tangible goods will be dispatched promptly after an order has been placed.

Pricing

All prices are in New Zealand Dollars and are inclusive of any Goods and Services Tax ("GST") unless stated to be otherwise but are exclusive of delivery charges. All prices are correct when published. We reserve the right to alter prices at any time.

An invoice will be emailed to you at the email address you supply when you place your order. You are responsible for ensuring that your contact details are correct.

Shipping and delivery

We aim to dispatch your order within 1-3 working days. Once your order is with the courier, please allow 1-3 days for delivery.

Warranties

All goods supplied by Inner Storage Limited are covered by the normal manufacturers' warranty.
  • If an item has failed prematurely please follow our process for warranties and returns
  • Please note that certain products need to be returned to our suppliers, for inspection and possible repair.
  • Goods are subject to the manufacturers' warranties. We will pass on the benefit of those warranties to you.
  • Where goods are subject to warranty, you are responsible for returning them to us. However, if the goods provided to you are faulty we will refund you delivery charges upon provision of proof of incurred costs.
  • Any warranty may be voided by damage to or misuse of the product, or problems caused by inadequate packaging or storage.
  • Proof of purchase is required. We will confirm through our systems that we have sold you the product(s) prior to return.

Process for warranties and returns

For all Warranties, Returns and Exchanges please follow the following steps:
  • Read the Warranties, Returns and Exchanges policy to check your warranty, returns or exchange is valid. If you have any questions please contact us on (021) 186-1116 or email info@innerstorage.nz
  • Using reasonable, protective packaging, return the item(s) to us by insured, traceable courier
  • Warranty and Returns do not cover:
    • Incorrect assembly, misuse, abuse or use of a product for which it was not designed.
    • Neglect and careless storage.
    • Unauthorised repairs.
    • Change of mind.
  • Please note: cash on delivery couriers will not be accepted.
  • Proof of purchase is required. We will confirm through our systems that we have sold you the product(s) prior to return.
  • Please note, any products that are being exchanged must be in a resalable condition with packaging intact and all labels returned with the item.
  • Please keep a record of your courier order details until you have received your replacement, credit or refund. We recommend you use recorded delivery or registered post to return items so as to cover yourself against loss.
  • We aim to process all returns as fast as possible.
  • Where you are eligible for a refund or exchange, the issuing of credit notes provides an alternative to a refund or exchange. These credit notes can be used to purchase anything from Inner Storage Limited online.

Returns and exchanges

  • Please note we will not accept returns for any non-faulty item that has been used, and/or had tags removed. We strongly advise all customers to check goods thoroughly upon delivery before removing any attached tags.
  • There is no return or exchange on sale items.
  • There is no return or exchange where the customer has had a change of mind, If the goods are faulty we will meet our obligations under the Consumer Guarantees Act.
  • Inner Storage Limited does not accept returns due to normal wear and tear on used items.
  • Wrong Sizes or Not the Right Part
    • Please make sure you contact us first on (021) 186-1116
    • If you ordered the wrong size please send it back to us within 10 days of receipt and we'll happily exchange it for another one in the correct size (if available) or another product of the same value. Additional freight charges may apply.
    • If you ordered a part without consultation from us, we can exchange the part provided that you pay for the freight to return the incorrect part.
    • Please note a restocking fee of up to 10% may apply.
    • Please note, products returned or exchanged must be in a brand new condition with packaging intact and all labels returned with the item(s).
    • The cost of freight, both for returning the item and sending any replacement, will be the responsibility of the customer. We recommend you use tracked delivery or registered post to return items so as to cover yourself against loss.
    • Generally proof of purchase is required. We may waive this requirement, in consultation with you, if we can confirm through our systems that we have sold you the product(s).
    • If we receive your return in a condition which we feel is not fit for exchange or refund we shall get in touch with you to discuss next steps. Inner Storage Limited reserves the right to refuse a return or exchange for any item sent back in a condition where the item has been used or damaged.
    • In the event of an exchange, items are subject to product availability.
    • Exchanged items can only be dispatched after the returned goods have been received and undergone a quality control check.
  • Damaged Goods
    • If the goods are not of acceptable quality we will meet our obligations under the Consumer Guarantees Act.
    • Please note that:
      (a) We will always quality check items before they leave Inner Storage Limited
      (b) It is your responsibility to check the goods on arrival before signing for them and to bring it to the attention of the courier company at time of delivery if they are damaged.
      (c) If at all possible please take a photo of the damage too.
    • If your order arrives in damaged condition please phone us within 3 days on (021) 186-1116 so we can follow up promptly with the courier company.
    • If the goods arrive damaged we will contact the courier company to arrange a pickup of the damaged goods and send you a replacement.
    • Generally proof of purchase is required. We may waive this requirement, in consultation with you, if we can confirm through our systems that we have sold you the product(s).
  • Faulty or Defective Goods
    • If your ordered item is found to be faulty or defective please see the warranties information above.
    • If the goods are faulty or not of acceptable quality we will meet our obligations under the Consumer Guarantees Act.
    • Generally proof of purchase is required. We may waive this requirement, in consultation with you, if we can confirm through our systems that we have sold you the product(s)


Liability Limitation

Where you acquire or hold yourself out as acquiring goods or services from us for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 will not apply. The conditions, warranties and guarantees set out in the Sale of Goods Act 1908 or otherwise implied by statute or common law will not apply and are excluded from these terms of trade.

We will always endeavour to have complete and accurate information on our website but to the greatest extent permissible by law we assume no responsibility for the completeness and current accuracy of the information provided on our website.


To the greatest extent permissible by law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. This exclusion also applies for the benefit of every officer, employee, contractor, agent of us and anyone else we use to perform our duties or provide services under any agreement you have with us. None of the persons specified above is liable or has to pay you for anything else in connection with or resulting from anything any of us does or does not do, or delays in doing, whether or not it is contemplated or authorised by any agreement you have with us. This exclusion applies whatever you are claiming for and in whatever way liability might arise. This exclusion does not limit any inalienable rights you may have under the Consumer Guarantees Act 1993.

Our maximum liability to you (if any) shall be limited to the value of any faulty products or services supplied by us and we, our employees, contractors and agents, will not be liable to you for loss or damage of any kind however that loss or damage is caused or arises.

Applicable law and jurisdiction

Unless we otherwise agree in writing, this agreement contains all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside.

Use of our website, supply of products or services by us to you and any other matter arising from these Terms and Conditions are subject to the laws of New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these terms of trade, or with the use of website or supply of any services.

Where you or any other person who you act for, or who you permit to act for you supplies incorrect information for the purchase of a product or service and we incur cost in any matter concerning that name then we may recover the costs incurred by us from you (including legal costs on a solicitor-client basis).

You agree to use our website, products and services in accordance with the applicable laws of the country or countries where your business or organisation is based.

Privacy policy and Confidentiality

Unless you opt to receive messages from us we will not contact you again in future. If you have opted to receive ongoing communications and at a later date you no longer wish to receive these communications you will be able to opt out of receiving this information by contacting us by email or by following the unsubscribe instructions at the bottom of emails sent to you.

Opting out of receiving the above mentioned messages will not prevent the sending of messages that specifically relate to your order(s).

We may use personal information that we collect about you to provide products and services to you and to administer orders and payments relating to your purchases from us.

You will need to permit us to place data files ("cookies") on your computer to enable you to use some features of some of our websites. Where you choose not to enable cookies from our Website, some functionality of those Website may not be available to you.

We may disclose your personal information as required by law.

Where you have provided information to us on a confidential basis, we will hold that information in confidence, except as required by law. We cannot guarantee that our website is secure, and we cannot be held responsible for a breach of our website security that is beyond our control.

You can request details of your personal information that we hold, and ask us to correct it, at any time.

General Conditions

We reserve the right to change these terms and conditions from time to time by notice, which may be in the form of a notice posted on our website at {www.innerstorage.nz}.

If we fail to enforce any terms or to exercise our rights under these terms and conditions at any time, we have not waived those rights.

If any provision of these terms and conditions is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these terms and conditions.

Unless any provision in this agreement expressly provides otherwise, these terms and conditions are not intended to confer a benefit on any person or class of person who is not a party to it.

We may deliver notices to you by sending them to an email address that you have notified to us.

ADDITIONAL TERMS AND CONDITIONS FOR QUOTES AND INSTALLATION:

1.All quotes are valid for 30 days.

2.Full payment is required on completion of the work quoted, at the time of the installation.

3.For indent items i.e QBL Depot Ski lockers, Once the deposit is paid and the order is placed with the supplier you have no right to cancel the order for any reason.

4.Unless otherwise stated all quotes exclude removal of any existing items in your Garage, Kitchen, or any other areas that work is to be carried out by Inner Storage Limited. Removal of any such items is required by you the customer before and work is carried out by Inner Storage Limited. This also includes the re-instatement of these items after the work is completed.

5.All quotes exclude pricing or any work to be done by any other trades, e.g.- plumber, electrician, plasterer etc. In the event Inner Storage Limited perform the installation the prices do not include any possible expense entailed in coping with hidden or unknown contingencies found at the job site or premise.

6.You are responsible for obtaining any Building Consents or any other approvals required for this work.

7.Delivery Dates: We do our best to meet agreed dates for delivery but Inner Storage Limited accepts no responsibility for delivery delays and any costs incurred.

8.All risk in, and responsibility for insuring goods supplied by Inner Storage Limited shall pass on to you on delivery. Title to the items supplied shall not pass to you until you have paid Inner Storage Limited the full price.

9.You shall make payment in full to Inner Storage Limited without setoff, deduction counter claim, retention or otherwise.

10. If you fail to make full payment to Inner Storage Limited by a due date for payment Inner Storage Limited may charge default interest on any amount outstanding at the rate of 2% per month plus any costs Inner Storage Limited incur recovering moneys due.

11. If you fail to make full payment by the due date Inner Storage Limited shall be entitled at any time thereafter to enter into the premises where the goods are, and retake possession of the goods until full payment is made, or to resell the goods to recover any deficiency on the resale.

12. You agree and acknowledge that if you acquire, or hold yourself out as acquiring, the products for business purposes in terms of the Consumer Guarantees Act, then that Act does not apply.

13. Except as required by law or expressly agreed, all conditions, descriptions, representations, warranties and guarantees, whether express or implied, by statute, trade or otherwise, in relation to the products are expressly excluded to the maximum extent permitted by law.

14. Except as required by law or expressly agreed, Inner Storage Limited do not accept responsibility for any loss, damage, any consequential indirect or special damage or loss of any kind whatsoever however caused (including through negligence), which you may directly or indirectly suffer in connection with your purchase of our products and services. Except as required by law or expressly agreed, if Inner Storage Limited is liable to you for any matter, that liability will be capped at the value of the specific good or part of the service which the liability relates to and in any event shall not exceed payments you made to Inner Storage Limited under this quote in the last 3 months.

15. Excluded from our quote are all matters not expressly listed in the quote. This includes sub trades (e.g.: electrician, plumber, painter etc.), building work, asbestos testing or removal of, crane or hi-ab hire or dump fees.

16. You agree that we may obtain information about you from you or another person in the course of our business, including, without limitation, your name, address, phone number, email address and credit information. You consent to us obtaining and holding such information.

All measurements and information included in this quotation are subject to change when the final measure is done. If any dimensions are altered after the order has been placed, then alteration costs will be chargeable
